As you’re hopefully aware by now, Article 20 of the Tobacco Products Directive will wipe all but the least effective e-cigs off the shelves - and drive millions of people back to smoking. This abhorrent legislation was cooked up behind closed doors, with no parliamentary scrutiny or discussion, and all EU member nations are now obliged to transpose it into law no later than next May. No impact assessment was ever conducted to assist regulators in passing this ''dogs dinner'' (http://www.clivebates.com/?p=3324). “There should be nothing about us without us'' has never been more applicable. Widespread support exists within the scientific, medical and public health communities for the recent Public Health England landmark announcement (https://www.gov.uk/government/publications/e-cigarettes-an-evidence-update) that acknowledged the shortcomings and unforeseen, unintended consequences of Article 20. It is widely recognised as bad law and must be rescinded. Totally Wicked have taken it upon themselves to challenge Article 20 in the Court of Justice of the European Union, with the hearing scheduled to take place on the 1st October this year. The legal challenge is our best hope for defeating Article 20. A petition has been running supporting the action which has been signed by over 60,000 people from across the nation (http://article20legalchallenge.com/).
